Donald Trump’s attempt to put his name on the Kennedy Center ran into another roadblock on Wednesday when a federal appeals court decided not to restore his name while a larger legal battle continues.
This means Trump’s name will stay off the Washington performing arts landmark after a lower court ordered it removed in June.
The conflict started when Trump removed board members, picked his supporters, took control as chairman, and had his name added to the institution that Congress created as the John F.
Kennedy Center for the Performing Arts.
U.S.
District Judge Christopher Cooper ruled in May that the board didn’t have the power to rename the center, stating that Congress had clearly made the facility a memorial for President John F.Kennedy and that only Congress could change that.
Trump and the Kennedy Center board asked the appeals court to put his name back on the building while the case is ongoing.
The judges didn’t agree.
In a unanimous decision, the three-judge panel said Trump and the board didn’t show they would face serious harm if his name stayed off the center during the appeal.
The court also rejected the idea that fundraising would be harmed, pointing out that no clear evidence was provided to back that claim.
The panel was also unimpressed with an argument related to a fundraising group called the “Trump Kennedy Center for the Performing Arts Foundation,” noting that the argument hadn’t even been brought up in the lower court.
One of the panel members, Judge Gregory Katsas, was appointed by Trump.
Representative Joyce Beatty, an Ohio Democrat who challenged the renaming, praised the decision.
“Today’s ruling again confirms that this administration’s attempts to rename the Kennedy Center were illegal,” Beatty said.”His name no longer ruins this sacred memorial, which belongs to the American people.”
For now, the building is still covered by tarps that were put up after Trump’s name was removed.
The name beneath the tarps hasn’t changed.
It still reads exactly as Congress intended over sixty years ago: the John F.Kennedy Center for the Performing Arts.
Enough is enough.
Stop this nonsense, Donnie.Washington, D.C.isn’t yours and never will be – it belongs to the American people, of which you are just one.
