Justice Samuel Alito has always been known for being a strong supporter of right-wing ideas, and he seems to care more about helping the MAGA movement, which promotes white supremacy, and helping billionaires than he does about the Constitution.Today’s dissent in the case Trump v.Barbara was a new low for him.
This whole case was wrong from the beginning – it was basically a test to see if someone could read and understand, and four Supreme Court justices chose to fail it on purpose.
The 14th Amendment says, “Section 1.
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.”
That’s pretty clear, right?
It says that anyone born in the United States is a citizen.That’s a straightforward rule.
But not for Samuel Alito.
He uses a different dictionary, one where every word means “whatever helps Donald Trump get what he wants.”
Legal experts have pointed out that Alito’s arguments conflict with those of his fellow justices, and they ignore 150 years of legal history.
His arguments have been described as “incoherent screeching.”
Chief Justice Roberts agreed, saying in his opinion that Alito is contradicting himself.
He wrote:
“JUSTICE ALITO seems to recognize this bind, so he would create an ad hoc exception for those whose parents have ‘done everything within their power .
..to become Americans.’ He does not explain how that exception can be squared with his view of the text, which (to repeat) is that anyone ‘automatically’ made a ‘national’ of his ‘parents’ native country’ was not entitled to citizenship under the Civil Rights Act.In our estimation, the Act raises more questions than answers—and was replaced by the Fourteenth Amendment, which ‘better’ expresses the views of the Reconstruction Congress anyway.”
Alito is contradicting himself because he doesn’t care.
He doesn’t care about the Constitution, the law, precedent, or what America really stands for or who we are as a people.
