Plaintiffs have shown that, without an injunction, there is a higher chance that many properly cast absentee or mail-in ballots will not be counted in the upcoming elections, said U.S.District Judge Carl J.Nichols, who issued a preliminary injunction.”The public has a strong interest in making sure that does not happen,” he added.
This decision joins another ruling from U.S.
District Court Judge Indira Talwani, who blocked Trump’s open efforts to weaken the midterm elections.Knowing that he is not popular and his party is heading into a tough midterm election, Trump is trying to put up as many obstacles as he can to voting. He understands that if fewer people vote, Republicans might have a better chance of not facing a complete loss in the election. If the executive order is carried out, millions of Americans could lose their right to vote.
The Supreme Court is currently looking at the administration’s appeal of Talwani’s order, and Nichols’ decision makes it even harder for the White House.
It’s important to note that Trump’s executive order won’t just change the way elections work.
There isn’t enough time to properly carry out the changes — which would require all ballot envelope designs to be approved by the Postal Service, as well as uploading data about mail voters to an online system that isn’t working yet — so Trump is clearly trying to create confusion in the midterms. He doesn’t care if the order can be properly followed, he wants to blame the failure to implement it as a reason to claim the election was illegal or stolen if his party loses.
“No law gives the Postal Service the authority to issue key parts of the rule,” wrote Nichols.
