Pirro’s office wrongly claimed that Hearn, an Olympic canoeist, had “forcefully and violently” pulled on the pool’s lining to destroy it.
Hearn had already said he wasn’t guilty of the charge of destroying property.If he had been found guilty, he could have gotten up to 10 years in prison.
The attempt to charge Hearn was clearly an effort by the administration to support Trump’s false and unrealistic claims.
They wanted to jail an innocent man so that Trump wouldn’t have to admit he messed up a national monument.
Clearly, the prosecution ran into trouble because their case was built on a lie.
There was no vandalism.Today’s filing admits that the pool’s lining started peeling almost right away after the work was done.
“The damage to the Lincoln Memorial Reflecting Pool in June 2026 was caused by poor installation by the contractor, Atlantic Industrial Coatings, and the rush to finish the project before the America 250 celebration in the weeks around Independence Day 2026,” the court filing explained.
