Legal experts say Chief Justice John Roberts is showing resistance to President Donald Trump after warning that criticizing judges could lead to personal attacks.
During a speech at Rice University in Houston this week, Roberts said that criticizing court decisions becomes a problem when it moves from discussing legal arguments to attacking individuals.
He said, “Their opinions can be criticized,” referring to judges throughout the country.
“But attacking them personally is dangerous and must stop.”
Legal analysts believe Roberts’ comments, coming from a conservative justice who Trump has recently criticized for a ruling on his tariff policy, are a subtle way of responding to the MAGA leader.
Michael Popok, a legal expert and host of the “Legal AF” podcast, said on Friday, “In one 48-hour period, the chairman of the Federal Reserve, the chief judge of the United States Supreme Court, and the chief judge of all things federal in the District of Columbia, all took on Donald Trump.”
“And it seems like John Roberts has had enough,” he added.
Legal attorney and analyst Karen Friedman Agnifilo said Roberts’ remarks were important but felt a stronger stance and consequences might be necessary.
“Good that the chief justice is speaking out now,” she said.
“But I think they need to be stronger and really talk about how bad this is… because it also weakens confidence and trust in the judiciary.”
Friedman Agnifilo also mentioned that Trump’s habit of publicly attacking judges and their families has contributed to what she called a “dangerous” atmosphere around the courts.
