U.S. District Judge Matthew Brann recently ruled that Attorney General Pam Bondi broke the law by putting three loyalists she picked in charge of the powerful U.S. Attorney’s Office in New Jersey, all at President Trump’s direct order.
Brann called the move an “unusual and complicated” attempt to gain power without going through the Senate’s usual approval process.
In a detailed 130-page decision, Brann said the President is upset that he can’t just name anyone he wants, and that Trump’s team is clearly frustrated by the legal limits set by the Constitution and the law.
The ruling removes the three acting leaders and makes things more confusing in an office that deals with big criminal and civil cases.
It also shows Trump’s wider plan to put loyal people in federal prosecutor offices around the country without going through the usual Senate or court approval steps.
Brann has temporarily paused his decision to give the Justice Department time to appeal, but he warned that if the illegal leaders stay in place, they do so “at their own risk.”
He also said he might have to throw out cases or convictions if the illegal setup continues.
This is a big setback for Trump’s control over the Justice Department.
A conservative judge is criticizing the administration for trying to break the rules and use the DOJ to support Trump’s agenda.
