On MediasTouch, former federal judge J. Michael Luttig gave a strong warning: over the last five years, every lower federal court judge has kept their promise to the Constitution by ruling against almost every big plan from President Trump as unconstitutional.
Luttig said, “Right now, the only people who can save America are the lower federal court judges.
And they are doing their job by following their oath in every case, and there are hundreds of these cases now.”
He called the current situation very sad: “Every time Donald Trump speaks or takes action, the American people have to go to court to fight it.
That’s the sad state America is in today.”
Luttig said the only thing stopping full control by the executive branch is the U.S. Supreme Court, which he thinks is keeping the American people from saving their democracy.
This follows as Trump’s administration faces hundreds of lawsuits over issues like his war in Iran, attempts to change election rules, overreach by the Department of Justice, and executive orders that break the Constitution.
Lower courts have kept stopping or rejecting his actions, while the Supreme Court is the last chance.
Luttig’s comments show increasing worry that the courts—especially the lower federal judges—are now the main group stopping the government from going too far.
